Health COmmitment & sparring disclaimer

Your body, your mind, your health. We’re all for taking risks and breaking rules, in fact we hate

rules, but what we would hate even more is for your health to be affected. So before you go hitting those PB’s, let’s just agree on a couple of things to ensure that you’re hitting peak performance and reaching your full potential.

Your commitment:

  • We’re all for setting goals and pushing boundaries, all we ask is for you to be confident of your own abilities and limits.
  • Get dizzy on the dance floor, not during your deadlifts. If at any point you feel ill or unable, please let us know that it’s time to tap out.
  • If the doc says NO then let us KNOW. If, to your knowledge, there is any reason as to why you must not exercise, now is your chance to spill.
  • Look sharp, stay focused. Vow to keep your eyes peeled and ears open for any warning notices or instructions regarding your safety.
  • If circumstances to your health are to change, please shout so you can renew this

Our commitment:

  • We promise to give you the freedom to freestyle and do your own thing. We respect and trust that you know your physical limits (please remember though that with great power comes great responsibility).

  • You know us by now, and boring we are not: but safety first! We commit to make the upmost effort in keeping our clubs and equipment safe for you to enjoy.

  • We don’t bite (often). We’re a friendly lot and at your disposal – we’re happy to answer any questions you may have but remember that we’re trained for gains and not sprains.

  • Exercise can sometimes be risky business and we know that accidents happen. We may not be trained medics, however we promise to report and direct you safely to those who are if needs be.

  • We’ve got your backs and we’ll give it our very best shot to make sure that our staff are qualified to the fitness industry standards as set out by the Register of Exercise Professionals.

So, these commitments are for guidance only. This is not a legally binding agreement between you and us and does not create any obligations which you or we must meet.

Disclaimer for Sparring Classes

I hereby confirm that I am 16 years of age and of sound mind that, to my knowledge, I have no conditions (medical, physical or otherwise) which prevent me from participating in contact sport.

I have not been advised by any qualified medical or other health practitioner not to participate in activities of a physical contact nature and am not aware of, nor have been advised of any condition, latent or otherwise, which might in any way be aggravated by participation in GYMBOX Sparring classes.

I have been advised by GYMBOX to take medical advice before participating in GYMBOX Sparring Classes and have either done so and am aware of the results and the risks inherent in my participation or have decided of my own volition not to take such advice.

I understand that as a condition to participating in GYMBOX’s Sparring, I will be required to comply fully with the terms of the GYMBOX Guidelines to Sparring as amended from time to time and confirm I have read and fully understood these GYMBOX Guidelines to Sparring. I agree to comply strictly with these Guidelines as amended from time to time whenever participating in GYMBOX Sparring and will tick the box below to agree to these Guidelines, evidencing my agreement to be bound by and strictly follow their terms.

I understand and acknowledge that GYMBOX Sparring involves a certain degree of physical contact with other Sparring partners, and that while GYMBOX will take all reasonable steps to minimise the risk of injury to those participating, given the nature of the activity such risk cannot be removed completely. In other words, even having taken all reasonable measures, GYMBOX cannot guarantee participants’ safety.

I acknowledge therefore, that I am participating in GYMBOX’s Sparring entirely at my own risk and agree to hold GYMBOX, its agents, employees and affiliated companies (“GYMBOX Parties”) harmless in relation to any injury whatsoever I may suffer in the course of GYMBOX Sparring which is not caused by the negligence of GYMBOX parties and to waive all rights, at law and otherwise, I may otherwise be entitled to against GYMBOX Parties in relation to loss, damage, injury or whatsoever nature suffered by me or my property as a result of my participation in GYMBOX Sparring which is not caused by the negligence of GYMBOX Parties.

I confirm that I have been advised by GYMBOX staff that, to the extent that I am unsure as to the meaning of any of the above provisions, I should take medical and legal advice before participating in GYMBOX Sparring and by ticking this box I confirm my full understanding of the above provisions.

HYPERBARIC OXYGEN THERAPY (HBOT) RELEASE & WAIVER

REPRESENTATION OF HEALTH AND AGE

I hereby confirm that I am at least 18 years of age and of sound mind. To the best of my knowledge, I have no medical or physical conditions that prevent me from participating in Hyperbaric Oxygen Therapy (HBOT).

DISCLOSURE OF CONTRAINDICATIONS

I acknowledge that I have NOT been advised by a medical professional to avoid HBOT. I understand that GYMBOX does not provide medical advice or diagnosis and relies on the information I provide. I confirm I am not aware of, and have not been diagnosed with, any of the following:

Absolute Contraindication:

  • Untreated Pneumothorax: I confirm I do not have an untreated collapsed lung, as decompression can lead to a life-threatening tension pneumothorax.

Relative Contraindications (Prior Medical Approval Required):

  • Medical History & Medications: I have disclosed if I have ever taken Bleomycin (even years ago), Doxorubicin (Adriamycin), Cis-platinum, Disulfiram (Antabuse), or Mafenide Acetate (Sulfamylon).
  • Respiratory: Emphysema with CO2 retention, lung blebs, upper respiratory infections, or chronic sinusitis (which may cause ear/sinus “squeeze”).
  • Neurological: History of seizure disorders or epilepsy (which increases the risk of oxygen-induced seizures).
  • Implanted Devices: I have disclosed the presence of any pacemaker, medicine pump, or nerve stimulator. I acknowledge that while many modern pacemakers are safe, other devices may not be certified for pressure.
  • Other: Pregnancy (elective treatment is generally deferred until after delivery) or known/active malignancies (cancers).

 

INDEPENDENT MEDICAL ADVICE

I acknowledge that GYMBOX has advised me to seek professional medical advice before participating. I confirm that:

  • I have either consulted a physician and am aware of the inherent risks; OR
  • I have voluntarily chosen not to seek medical advice and accept all associated risks.

 

COMPLIANCE WITH GUIDELINES

I agree to strictly comply with the GYMBOX Guidelines to Hyperbaric Oxygen Therapy. I confirm that I have read and fully understood these Guidelines. Failure to follow these rules may result in immediate termination of the session.

ASSUMPTION OF RISK AND WAIVER OF LIABILITY

I understand that HBOT involves a degree of personal risk. While GYMBOX takes reasonable steps to minimize these risks, they cannot be eliminated entirely.

  • Assumption of Risk: I participate in GYMBOX’s HBOT entirely at my own risk.
  • Waiver: I agree to hold GYMBOX, its agents, and employees (“GYMBOX Parties”) harmless regarding any injury or property damage suffered during therapy.
  • Negligence Carve-out: This waiver does not apply to loss or injury caused by the proven negligence of GYMBOX Parties.
  • Rights Waiver: I waive all rights at law to bring claims against GYMBOX Parties for any non-negligent injury or loss resulting from my participation.

 

CONFIRMATION OF UNDERSTANDING

Hyperbaric Oxygen Therapy provided by GYMBOX is offered as a wellness and recovery service and is not a substitute for medical treatment or diagnosis.

 

I have been advised by GYMBOX that if I am unsure of any provision in this document, I should seek legal and medical advice before continuing. I understand that failure to disclose relevant medical information may increase my risk of injury and may invalidate this consent.
